Official Rules (“Official Rules”)

No purchase necessary to enter, win, or claim a prize. A purchase will not increase your chances of winning. Applicants must be at least 18 years of age (or the age of majority in their state of residence), a legal resident of the 50 United States or the District of Columbia, and meet all other eligibility requirements to be eligible to enter. Void where restricted or prohibited.

By participating in this sweepstakes, you agree to be bound by these Official Rules and the decisions of the Sponsor, which are binding and final in all matters relating to this sweepstakes. This sweepstakes is in no way endorsed, sponsored, administered by, or associated with Instagram.

The “My 500” Sweepstakes (“the Sweepstakes”) is sponsored and administered by Grow By Three, LLC (“Grow By Three”), PO Box 2140, Garden City, NY 11531 (“Sponsor”).

Sweepstakes Period: The Sweepstakes begins at 12:00:01 a.m. Eastern Time (“ET”) on April 9, 2025 (04/09/2025) and ends at 11:59:59 p.m. ET on May 23, 2025 (05/23/2025) (“Sweepstakes Period”).

How To Enter: To enter, entrants must visit https://www.growbythree.com/themagneticsection500 and follow the instructions provided to submit a completed online entry form, and “follow” @TheMagneticSection on Instagram.

Any prospective entrant without an Instagram account can create one, free of charge, at www.instagram.com. The Sweepstakes is in no way endorsed, sponsored, administered by, or associated with Instagram.

Entrants’ completed online entry form and the account they use to follow @TheMagneticSection (“Means of Entry”) must be free from offensive, vulgar, pornographic, illegal, infringing, or otherwise inappropriate content (“Disqualifying Content”). Sponsor reserves the right, in its sole discretion, to determine whether any Means of Entry contain Disqualifying Content. If such determination is made, the Means of Entry shall be disqualified, rendering the entry invalid. Only valid entries are eligible to win.

Limit one entry per person, and no other method of entry is acceptable. All entries must be received during the Sweepstakes Period. Use of artificial intelligence, robotics, bots, computer-programmed scripts or macros, and/or other digital means to submit multiple entries will result in entry disqualification.

Grow By Three is not responsible for incomplete or incorrect entries. All entries are subject to verification by Grow By Three and become property of Grow By Three. By entering the Sweepstakes, entrants agree to these Official Rules and Sponsor’s Privacy Policy.

Sponsor reserves the right, in its sole discretion, (i) to verify any element of any entry, including but not limited to: age, residency, valid completion of the entry form, and following @TheMagneticSection on Instagram; and (ii) to request additional information. By entering this Sweepstakes, entrants agree to provide any documentation or information deemed necessary by, and in a form acceptable to, Sponsor in order to satisfy requests for additional information.

Winning the Sweepstakes is contingent on fulfilling all requirements set forth herein in these Official Rules. Participation constitutes entrant’s full and unconditional agreement to these Official Rules, as well as Sponsor’s decisions, which are final and binding in all matters related to the Sweepstakes.

Additional Eligibility Information: All federal, state, and local laws and regulations apply. This Sweepstakes is only open to legal residents of one of the fifty United States and the District of Columbia. To be eligible, entrants must be at least 18 years of age, or the age of majority in their state of residence.

During the Sweepstakes Period, any current employees or contractors of Sponsor and any other organizations affiliated with the Sweepstakes, as well as their immediate family members (including parents, step-parents, spouses, children, step-children, siblings, or step-siblings) regardless of where they reside, or household members, whether related or not, are not eligible to enter or win. Past winners of any other sweepstakes or awards offered by Sponsor are not eligible to enter or win.

Consent to Contact: By participating in the Sweepstakes, entrants grant Sponsor express consent to receive email and other communications from Sponsor and any affiliates associated with the Sweepstakes.

Selection of Winner and Notification: The odds of winning the prize depend on the number of valid entries Sponsor receives during the Sweepstakes Period. At a time and date determined by Sponsor in its sole discretion, but within thirty (30) days after the Sweepstakes Period, Sponsor will conduct a random drawing from among all valid entries received.

The entrant who submitted the entry drawn by Sponsor (“Selected Entrant”) will be notified via email and will be required to reply to the email within forty-eight (48) hours to claim the prize. To be considered the winner of the Sweepstakes (“Winner”), after claiming the prize, the Selected Entrant must return a Release Form, an Affidavit of Eligibility, and/or an IRS Form W-9 (if required) by 11:59:59 p.m. ET on the seventh (7th) day following the date of the original notification email, unless otherwise specified by Sponsor in writing. If Sponsor is unable to contact the Selected Entrant, Selected Entrant does not claim the prize within the specified time period, Selected Entrant does not return the required documents within the specified time period, or Selected Entrant is not in compliance with these Official Rules, the prize will be forfeited and, at Sponsor's discretion, an alternative entry may be selected. This alternative entry will be selected in a random drawing from among all remaining eligible entries.

Prize: One (1) prize will be awarded. This prize will be a five-hundred dollar ($500.00) payment provided to the winner. The approximate retail value of this prize is $500.00 United States Dollars. All prize details are at Sponsor’s sole discretion. Sponsor reserves the right to substitute prize, or portion thereof, with one of comparable or greater value. Prizes are non-transferable and no substitution will be made except as provided at Sponsor’s sole discretion. Winner is responsible for all applicable federal, state and local taxes, if any, as well as any other costs and expenses associated with prize acceptance and use.

Privacy: Any personally identifiable information submitted during an entrant’s participation in the Sweepstakes will be collected by Sponsor in accordance with Sponsor’s Privacy Policy that can be found at https://www.growbythree.com/privacypolicy.

Entering into the Sweepstakes constitutes entrant’s consent to Sponsor’s ability to use, display, publish, exhibit, and/or promote across any medium, in perpetuity, information provided within entrant’s Means of Entry. Such ability will be limited to legitimate business purposes and will not require future consideration or compensation from Sponsor or affiliates associated with the Sweepstakes.

Releases: By participating, entrants agree to these Official Rules and that the decisions of the Sponsor will be final and binding, and agree on behalf of themselves and their respective heirs, executors, legal representatives, administrators, and assigns (“Releasing Parties”), to release and hold harmless the Sponsor, as well as their affiliates, employees, contractors, officers, directors and agents (“Released Parties”), from and against any and all causes of actions arising from participation in the Sweepstakes or receipt or use of any prize, including but not limited to: (a) unauthorized human intervention in the Sweepstakes; (b) typographical errors; (c) technical errors related to software, computer systems, computers, servers, providers, or telephone or network lines; (d) errors in the administration of the Sweepstakes or the processing of entries; or (e) injury or damages to person or property. In any cause of action, in no event shall any of the Released Parties be liable for attorney’s fees. By participation, entrants waive the right to claim any damages whatsoever, including but not limited to, indirect, direct, consequential, incidental, punitive, or exemplary damages arising from use of the website or entry into the Sweepstakes.

Released Parties are not responsible for any issues relating to the submission of the entry form, including any lost, late, incomplete, incorrect, damaged, inaccurate, or undelivered entries; or for lost, interrupted or unavailable network, servers, internet connections, or any technical errors or malfunctions that occur relating to or in connection with the Sweepstakes, including, but not limited to, errors or difficulties which may occur in connection with the administration of the Sweepstakes, the processing of entries, the announcement of the winner, or in any Sweepstakes-related materials. Released Parties are not responsible for injury or damage to entrants’ or to any other person’s computer related to or resulting from participating in this Sweepstakes.

Security: Sponsor reserves the right, in its sole discretion, to disqualify any person tampering with the entry process, the operation of associated websites, the administration or operation of the Sweepstakes, or any person who is otherwise in violation of these Official Rules.

In the event that the operation, security, or administration of the Sweepstakes is impaired in any way, Sponsor has the sole discretion to, either (a) select the potential winner in a random drawing from among all eligible, non-suspect entries received prior to date of impairment or termination; or (b) suspend the Sweepstakes to address the impairment and then resume the Sweepstakes in a manner that is most consistent to the spirit of these Official Rules.

Sponsor reserves the right to disqualify any person or entrant who makes an attempt to deliberately damage the website, interfere with Sponsor’s business operations, or hinder the Sweepstakes in violation of criminal and civil laws. Sponsor also reserves the right to seek damages, including attorney's fees, and other remedies from any such individual to the fullest extent permitted by law.

Trade names, trademarks, or service marks shown as part of the materials associated with the Sweepstakes are the property of their respective owners.

Force Majeure Event: Sponsor is not responsible in the event that Sponsor is prevented from continuing with the Sweepstakes as contemplated herein by any event beyond its control, including but not limited to fire, pandemic, epidemic, governmental regulation, war, natural disasters, weather, acts or threats of terrorism, lockouts, tampering, unauthorized intervention, fraud, technical failures or other events outside of the reasonable control of the Sponsor (each a “Force Majeure Event”). If the Sweepstakes cannot take place as planned, in whole or in part, or if the prize cannot be awarded due to a Force Majeure Event, or if a Force Majeure Event corrupts or affects the administration, security, fairness, or integrity of the Sweepstakes, Sponsor reserves the right, in its sole discretion, to cancel, terminate, modify, or suspend the Sweepstakes, the prize, or any portion thereof.

Waiver: Failure by Sponsor to enforce any terms of these Official Rules shall not constitute a waiver of that provision.

Disputes: All issues and questions concerning the construction, validity, interpretation, and enforceability of these Official Rules, an entrant’s or Sponsor’s rights and obligations in connection with this Sweepstakes, shall be governed and construed in accordance with, the laws of the Commonwealth of Massachusetts, without giving effect to any choice of law or conflict of law rules, which would cause the application of the laws of any jurisdiction other than the Commonwealth of Massachusetts.

As a condition of participating in this Sweepstakes, Releasing Parties agree that any and all disputes, claims, and causes of action arising out of, or connected with, the Sweepstakes or the prize awarded shall be resolved individually, without resort to any form of class action, and exclusively through final and binding arbitration to be administrated in Massachusetts, or remotely, by National Arbitration and Mediation (“NAM”). Releasing Parties also agree that such arbitration proceedings shall be governed by NAM’s Comprehensive Rules and Procedures and the fee schedule in effect at the time such claim is filed.
